Your privacy is important to Osprey, so we’ve developed this Privacy Policy to show you what information we collect, how it’s used, and what we share.
Osprey Technologies, Inc (“Osprey,” “we,” “our,” and/or “us”) values the privacy of those who use our website and mobile applications (collectively, the “Platform” or “Osprey Platform”). This Privacy Policy (“Privacy Policy”) explains what information we collect, how it’s used, and what we share from individuals who use the Osprey Platform (“Users”). The Privacy Policy applies to our Customers, individuals who deliver orders placed through the Platform by Customers (“Drivers”), including anyone who signs up to become a Driver (“Potential Drivers”), businesses selling products through the Platform (“Retailers”), or any other partner(s) who use the Platform as means of facilitating the delivery and/or sale of goods and services (“Partners”). By using the Platform, you are agreeing to this Privacy Policy and the practices listed herein, as well as any future additions, amendments, revisions, alterations, or modifications. Capitalized Terms listed within this Privacy Policy that are not defined herein have the definition given to them in our Terms and Conditions.
We collect information when you create an account or when you use the Platform. We also collect information when you send messages through the Platform and information from your contacts list (“Contacts”), if you grant us access to do so through your mobile device.
From certain activities, such as creating an account, uploading content to the Platform, or contacting us, you may directly provide us with some of the following information:
Sign Up and Profile Information. When you sign up for an account with Osprey, or place an order through the Platform, you provide us with information including your name, physical address, phone number, age and date of birth, and an email address. If you sign up using Facebook we will receive information such as your name and email address. We may request you provide us with a photograph of yourself.
Orders. When you place an order through the Platform, we collect information related to that order which may include items purchased, special instructions, date and time of order, and subtotal.
Payment Information. When you add a card or other form of payment to your Osprey account, a third-party payment processing service receives and stores your payment information. Osprey does not directly store your full payment information on our servers.
Feedback. When you provide feedback to us, a Driver, or a Retailer, we collect information which may include your name, email address, rating, the relevant Retailer, or the Relevant Driver.
Sign Up and Profile Information. When you sign up to become a Driver or use the Platform to perform Delivery Services, you may provide us with information including your legal name, date of birth, email address, physical address, phone number, and photo identification. We may choose to share this information with a third-party provider to conduct a background check on you. Additional information may be collected from you to operate the Platform as necessary.
Payment Information. We may collect certain financial information to use as part of our operations, such as facilitating payments to Drivers, or for legal reasons, such as tax reporting purposes. This information may include bank and bank account information, including routing and account numbers, and order payment information.
Feedback and Surveys. When you provide feedback to us, a Customer, or a Retailer, we collect information which may include your name, email address, rating, the relevant Retailer, or the Relevant Driver.
Sign Up and Profile Information. When a Retailer or Partner signs up for an account with us, or uses the Platform, we may collect information including, but not limited to contact name, phone number, email address, legal business name, physical address, business hours, and product details, including product names, descriptions, and prices.
Payment Information. We may collect certain financial information from Retailers, including bank and bank account information necessary to facilitate payment to Retailers, and other information necessary to facilitate payments.
Communications. We may collect and store information when you contact us, e.g. if you contact our Customer Support Team, we may collect and store certain information, including your name, email address, and any content within the message you send, including photographs and text, and any other information you choose to provide to us.
Feedback. Customers and Drivers are able to rate each other at the end of each completed delivery. During the delivery, Customers may be able to see a Driver’s average rating. Drivers are also able to see their average rating. Customers are further able to provide us with information regarding their experience with the Platform, including, but not limited to Retailer reviews, Retailer ratings, Retailer Product reviews, Retailer Product ratings and order reviews.
When you use the Platform, there is some information that we collect automatically, such as location information and usage information.
Device Information. We collect information about Users’ devices including IP address, mobile operating system, model of your device, your time zone, unique device identifiers, phone carrier, phone manufacturer, other information like your web browser type, and if you register with Facebook, we collect your Facebook identifier.
Location and Sensor Data. When you use the Osprey app, including in the background, we collect Users’ location data. For Drivers and Potential Drivers, we collect location data and motion sensor data in order to personalize your experience with the app and assist in the process of finding delivery opportunities, tracking your progress and delivery completion, and other similar purposes. We similarly use this information for analytics purposes.
Usage Information. When you interact with the Platform we collect information about your interactions to help us understand how you use the Platform, how we can make it better for you, and how we can improve the Platform for all Users. This information may include interactions such as the time you visit the Platform, the products or Retailers you view, products you add to your cart, and other similar information.
Cookies. Osprey, our service providers, and our business partners use cookies and other similar technologies to automatically collect information, analyze and understand how you use the Platform, learn which content is popular, including products and Retailers, save your preferences, and overall enhance your experience with the Platform. Cookies are small files which, when placed on your device, enable the Platform to provide certain features, functionality, and store basic information. We may use both session cookies and persistent cookies. Session cookies disappear after you close your browser or the application. Persistent cookies do not disappear when you close your browser or the application and may be accessed each time you use the Platform (i.e. open the application). You can change your cookie settings within your browser settings or device settings. Please note that if you delete or choose not to accept cookies from the Platform, certain features that require cookies to function may be disabled for you.
We may collect information listed in this Privacy Policy from publicly-available sources or third-parties.
Driver Background Checks. We may use third-party providers to help conduct background checks on potential or active Drivers. The providers may conduct driving and criminal background checks on Drivers at Osprey’s request so we can ensure the Platform remains safe for everyone. As a part of the background check process, the providers may occasionally report driving or criminal records to Osprey.
Other Sources. We may collect information about you from other publicly available sources, and may combine this information with the information we collect through your use of the Platform.
We use the information we collect from Users to understand how they are using the Platform, to approve and administer the Platform, and to provide them with services and features. We also may use Users’ data for the business and commercial purposes listed below:
Provide Platform Features and Functionality. Osprey uses the data we collect from our Users to provide, customize, improve, and promote the Platform. Some uses of data in respect to providing the Platform are:
Communicating with You. We use the data we collect to communicate with you, such as by sending a text or other form of notification about the status of your deliveries or orders. We may also use data for marketing and promotional reasons, such as emailing you. If we send a marketing email to you, there will always be a link located at the bottom of the message for you to “Unsubscribe” from receiving future marketing and promotional emails.
Osprey also uses the data we collect for customer service purposes. For example, we may use data to respond to User questions or concerns.
Enforcing our Terms & Conditions and Policies. When you use or access the Platform and any Software or Services, you are legally bound to our Terms & Conditions and this Privacy Policy. We use your personal information to ensure you are compliant with our agreements, policies, and terms, including investigating and preventing violations of our agreements, policies, and terms, or investigating and preventing illegal activities on the Platform.
Research and Development. To improve the experience on the Platform and other research and developmental purposes, we may use Users’ data for testing, analysis, and product development.
Safety and Security. We use information we collect from you to protect you, others, and our business. We may use data to detect and prevent fraud, comply with the law, and protect you, others, and our business from security risks.
Our Business Purposes. We may combine data or make it unidentifiable, and may use this data for any purpose, including but not limited to research or marketing purposes, or sharing it with any third party for business-related reasons.
Legal and Regulatory Purposes. Our Services and the Platform itself are subjected to certain laws and regulations, and we may use your data to maintain compliance with such laws. For example, we may use your data to respond to questions from legal officials, regulators, or government entities, to pay our taxes and/or fulfill business operations, or to enforce any legal agreements or policies that govern your use of the Platform.
We want to gain and maintain your trust, so we want you to know with whom we share your personal information, and we want you to understand that we never sell your information to third-parties.
Service Providers. For business-related purposes we may share your personal information with third-party service providers. We may share your personal information with third-party service providers in order for them to provide us with their services, such as payment processing or customer support services. When we share your personal information to third-party service providers and business partners they are given access to the information solely for performing services on our behalf and are strictly required to keep this information internal and not to disclose it to any third-parties.
Within our Company. We may share your information with a subsidiary or other affiliate of our company.
Sale, Merger, or other Business Transfer. In the event that Osprey undergoes a sale, transfer, merger, reorganization, dissolution, or other similar event, we may share your information with a third-party, including during the negotiation stages of the transaction.
Customers and Drivers. To allow deliveries, Customers and Drivers may be able to see certain information about one another. Upon receiving a Delivery Opportunity, the Driver may be able to see the Customer’s first name and last initial, as well as their delivery address. Once they accept a Delivery Opportunity, Drivers are able to see and use the Customer’s phone number to call or text message them exclusively for the purpose of updating them regarding their order or delivery, or for seeking assistance regarding the delivery location. When an order is assigned to a Driver, the Customer can see the Driver’s photo, first name, last initial, real-time location, and average rating. Drivers can also see their average rating, and any information you put in the fields at the checkout page, such as delivery instructions.
Drivers, Retailers, and Partners. Prior to a Driver picking up an order for delivery, the Retailer or Partner may be able to see the Driver’s first name, last initial, and real-time location. The Retailer or Partner may also be able to communicate with the Driver.
Customers, Retailers, and Partners. We may share information, including your first name, last initial, and order information with the Retailer or Partner with whom you have placed your order. This information is shared with the Retailer or Partner to facilitate deliveries.
Other Purposes. We also may share your information with third-parties for the following purposes:
Osprey is not intended for children under the age of 13, and we do not knowingly collect personal information from children under the age of 13. If you believe that a child under the age of 13 has disclosed personal information to us, please contact us at ospreydelivery.com/contact. If we become aware of an account owned or operated by a child under the age of 13, we will terminate the person’s account upon review and confirmation.
You may choose to enable or log in to our Platform via various online services, including social networking services like Facebook and Google. Our Services also may enable you to access social networking services such as Facebook, Twitter, Instagram, or Snapchat (collectively, “Social Network”) directly or indirectly through our Platform.
When you link a Social Network account to Osprey or log into the Platform using your Social Network account, we may collect relevant Personal Information necessary to enable our Services to access that Social Network and your information contained within that Social Network. We also may share your information with the operator of that Social Network to facilitate or enhance delivery of that Social Network or other services to you. A Social Network may provide us with access to certain information that you have provided to them, and we will use, store, and disclose such information in accordance with this Privacy Policy. Additionally, a Social Network may collect Personal Information and information about your use of the Platform automatically. The manner in which a Social Network collects, uses, stores, and discloses your information is governed by the policies of such third parties and Osprey shall have no liability or responsibility for the privacy practices or other actions of any Social Network that may be enabled within the Platform.
This section lists the privacy-related rights (“Privacy Rights”) that are applicable to all Osprey Users.
Deletion. You have the right to request deletion of any personal information we have collected about you. Your request will be subjected to verification and the response will be in accordance with applicable law. At times, and in compliance with applicable law, we may save personal information, including without limitation when such information is needed for legal reasons, to collect fees owed by you, resolve disputes, prevent fraud, analyze how Users use the Platform, or to assist with any investigation(s).
Modification. You have the right to modify certain personal information we have collected about you, such as your name or phone number. To do so, visit the “Account” section of our mobile application.
Know. You have the right to know what personal information we collect, disclose, use, and share about you. However, we cannot always disclose this information to you, including without limitation when it would jeopardize the security of your account, the Platform, our systems, other Users, or the personal information itself.
Non-Discrimination. Osprey does not discriminate against Users who exercise their Privacy Rights. For clarity, if you exercise your Privacy Rights we will not charge you higher rates, deny you access to the Platform or certain features of the Platform, or reduce the quality of service you receive.
The Platform may contain links to third-party websites, products, services or applications that are not owned or operated by Osprey. We have no control over these third-parties and are not responsible for their privacy policies or practices. Before you provide a third-party with any personal information, we encourage you to read and understand their privacy policies and practices.
We take the security of our Users’ data and personal information seriously. We use strategic and logical software and digital protections to prevent any unauthorized loss, theft, or access to your data and personal information. No security measures are accurate all the time, so should you have any reason whatsoever to believe your account has been compromised, please contact us immediately at ospreydelivery.com/contact.
Parts of the Platform integrate third-party services, such as Google Maps, Google Maps API(s), and Stripe payment processing. When you use the Platform and these services your use is subject to their respective terms and privacy policies.
From time to time we will revise and modify our Privacy Policy. The latest and effective Privacy Policy will be listed at ospreydelivery.com/privacy and we will update the “Effective” date at the top of this Privacy Policy when changes or revisions have been made. We encourage you to review the Privacy Policy periodically and familiarize yourself with the effective Privacy Policy, because as long as you use the Platform, you are agreeing to the effective Privacy Policy.
